1. Acceptance of terms
These Terms and Conditions ("Terms") form an agreement between you and Airfoto ("Airfoto", "we", "us") covering airfotoai.com, the Airfoto console at console.airfotoai.com, and the Airfoto API (together, the "Service").
By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you use Airfoto on behalf of an organisation, you confirm you have authority to bind it, and "you" includes that organisation. If you do not agree, do not use the Service.
2. The service
Airfoto processes aerial imagery you upload, such as orthomosaics, GeoTIFFs and orthophotos, and uses computer vision to detect and extract features like buildings, roads and trees. It delivers results as vector layers and analytics in formats such as shapefile, GeoJSON and KML.
Features and limits depend on your plan. We may improve, add or remove features over time.
3. Accounts
- You must be at least 18 years old and able to enter a binding contract.
- Give accurate information when you sign up and keep it up to date.
- Keep your password and API keys confidential. You are responsible for activity under your account. Tell us promptly at info@airfotoai.com if you suspect unauthorised access.
- Do not share an account between individuals unless your plan includes team collaboration.
4. Plans and payment
Airfoto offers a free Starter plan, a paid Professional plan and custom Enterprise plans. The features and limits of each are described on our pricing section and may change with notice.
- Billing: paid plans are billed in advance, monthly unless agreed otherwise. Fees are stated in US dollars and exclude applicable taxes.
- Renewal: paid plans renew automatically until cancelled. You can cancel at any time and your plan continues until the end of the paid period.
- Free trials: if a trial applies, you will be charged at the end of it unless you cancel first.
- Refunds: except where required by law or stated in an Enterprise agreement, fees already paid are not refundable.
- Price changes: we will give you reasonable notice before changing the price of your plan.
5. Acceptable use
You agree not to:
- Break any law or regulation, including laws on aerial imaging, drones, privacy and surveillance.
- Upload imagery you do not have the right to capture, use or share.
- Use the Service to unlawfully track, identify or surveil individuals, or to support human rights abuses.
- Attempt to access other users' data, probe or test the security of the Service without our written permission, or disrupt its operation.
- Reverse engineer, copy or extract our models, or use the Service or its outputs to build a competing product.
- Upload malware or content that is unlawful, infringing or harmful.
- Resell or provide access to the Service to third parties without our written agreement.
- Exceed or circumvent plan limits or rate limits.
6. Your content
You keep ownership of the imagery you upload and the vector outputs generated from it ("Your Content").
You give us a limited, non-exclusive licence to host, process and display Your Content solely to provide the Service to you, including running it through our computer vision engines and delivering results. We do not use Your Content to train models for other customers without your permission. More detail is in our Privacy Policy.
You are responsible for Your Content, for having all rights and permissions needed to upload and process it, and for how you use the outputs. Please keep your own backups; the Service is not a backup or archival system.
7. Our intellectual property
The Service, including its software, models, interface, branding and documentation, belongs to Airfoto and its licensors and is protected by intellectual property laws. These Terms give you a limited, revocable, non-transferable right to use the Service for your own internal business purposes. No other rights are granted.
If you send us feedback or suggestions, we may use them without restriction or payment.
8. AI outputs and accuracy
Airfoto's results are generated by machine learning models. Detections can be incomplete, incorrect or vary with image quality, resolution, terrain and conditions. Measurements and analytics are estimates.
You are responsible for reviewing outputs and for decisions you make based on them. Do not rely on the Service alone for safety-critical, legal, survey or engineering decisions without independent verification by a qualified professional.
9. API use
If your plan includes API access, you must keep your keys secure, follow the documentation and stay within rate and usage limits. We may suspend keys that are abused, compromised or used in breach of these Terms.
10. Availability and changes
We aim to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. We may carry out maintenance, and the Service may be affected by events outside our control. Unless an Enterprise agreement states a service level, no uptime commitment applies.
We may update these Terms. If a change is material we will notify you by email or in the console, and the effective date above will change. Continuing to use the Service after a change means you accept the updated Terms.
11. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, if your account poses a security risk, or if payment is overdue. Where reasonable, we will give you notice first.
After termination you should download the outputs you need. We will delete Your Content as described in our Privacy Policy. Sections that by their nature should survive termination, such as those on intellectual property, disclaimers, liability and governing law, will continue to apply.
12. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. Some jurisdictions do not allow certain exclusions, so some of these may not apply to you.
13. Limitation of liability
To the fullest extent permitted by law, Airfoto and its team will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill, arising from your use of the Service.
Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim, or US$100 if you use the free plan. Nothing in these Terms limits liability that cannot be limited by law.
14. Indemnity
You agree to defend and indemnify Airfoto against claims, losses and expenses, including reasonable legal fees, arising from Your Content, your breach of these Terms, or your violation of any law or third-party right.
15. Governing law
These Terms are governed by the laws of the Republic of Ghana. We encourage you to contact us first to resolve any dispute informally. If that does not work, the courts of Ghana have jurisdiction, unless an Enterprise agreement states otherwise or mandatory consumer law in your country provides differently.
16. General
- Entire agreement: these Terms, the Privacy Policy and any Enterprise agreement are the whole agreement between us on the Service.
- Severability: if a provision is unenforceable, the rest remains in effect.
- No waiver: failing to enforce a right does not waive it.
- Assignment: you may not assign these Terms without our consent. We may assign them in connection with a merger or sale of the business.
